1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the Search & Discover mobile application and associated website (the "Service"), operated by Digital UWU ("we," "us," or "our"). By accessing or using the Service, you accept and agree to be bound by these Terms and our Privacy Policy.
2. Description of Service
Search & Discover is an NFC-based scavenger hunt platform that provides:
- Tools for organizers to create games, register NFC tags, and share join codes
- A mobile experience for players to join games and scan NFC tags to score points
- Real-time leaderboards and game state management
- Multiple game modes: Race, Capture, and Grind
- Offline scan queuing with automatic submission on reconnection
3. User Accounts
Registration
You may use the Service as a guest (display name only) or by creating a registered account using an email address or Google sign-in. You agree to provide accurate, current, and complete information and to keep it up to date.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@digitaluwu.com if you suspect any unauthorised access to your account.
Guest Accounts
Guest users may participate in a single active game without creating a persistent account. Guest sessions are not linked to a persistent identity and game history is not retained after the session ends.
4. Organizer Responsibilities
If you use the Service as an organizer to create and run games, you additionally agree to:
- Lawful tag placement: Only place NFC tags in locations where you have permission to do so. Do not place tags on private property without authorisation, in unsafe locations, or in a manner that causes damage or nuisance.
- Game content: Ensure that your game names, tag names, and any custom messages comply with these Terms and do not contain content that is offensive, illegal, or harmful.
- Player safety: Design games with participant safety in mind. Do not design games that would require players to enter dangerous areas, trespass, or engage in illegal activity.
- Local laws: Ensure your game complies with all applicable local laws and regulations, including any requirements for public events or gatherings.
- Tag removal: Remove all physical NFC tags after your game ends.
We are not responsible for the actions of organizers or the content of games created through the Service.
5. Player Conduct
As a player, you agree not to:
- Attempt to spoof, forge, or simulate NFC tag signals to gain an unfair advantage
- Tamper with, remove, or damage physical NFC tags placed by organizers
- Harass, threaten, or abuse other players or organizers
- Use automated tools or scripts to interact with the Service
- Exploit bugs or vulnerabilities to gain an unfair advantage
- Impersonate another player or person
6. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe upon the intellectual property rights of others
- Upload or transmit malicious code or content
- Interfere with or disrupt the Service or its infrastructure
- Attempt to gain unauthorised access to our systems or other users' accounts
- Collect personal data about other users without their consent
7. NFC Hardware Disclaimer
The Service requires a device with NFC hardware to scan tags and participate in gameplay. We do not guarantee that the Service will function on all devices or operating system versions. NFC availability, scan reliability, and background tag detection are subject to limitations imposed by the device manufacturer and operating system. We are not responsible for any inability to participate in a game due to hardware or software limitations of your device.
8. Intellectual Property
Our Rights
The Service and its original content, features, and functionality are owned by Digital UWU and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.
Your Content
You retain ownership of any content you create within the Service (e.g., game names, tag labels, custom messages). By using the Service, you grant Digital UWU a limited, non-exclusive, royalty-free licence to store and display that content for the purpose of operating and improving the Service.
9. Termination
We may suspend or terminate your access to the Service at any time, without prior notice, if we reasonably believe you have violated these Terms or for any other reason at our discretion. You may stop using the Service and delete your account at any time. Provisions of these Terms that by their nature should survive termination will continue to apply.
10. Disclaimers
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Participation in physical scavenger hunts involves real-world activity; we are not responsible for any injury, loss, or damage that occurs during gameplay.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Digital UWU and its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Service โ including damages for lost data, lost profits, personal injury, or property damage โ even if we have been advised of the possibility of such damages.
12. Changes to Terms
We reserve the right to modify these Terms at any time. If a revision is material, we will provide at least 30 days' notice by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any changes take effect constitutes your acceptance of the revised Terms.
13. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation before resorting to formal proceedings.
